1. Acceptance of Terms

These Terms apply to all users, including those who access the Service without formal registration. MiKiSite.Com reserves the right to update or modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service, and continued use constitutes acceptance of the updated Terms.

2. Account Registration & Responsibilities

To use the Service, you must create an account by providing accurate, complete, and current information. You may register using email/password or via Google OAuth. You must be at least 18 years old to use the Service.

You agree to:

• Keep your password confidential and not share account access
• Notify MiKiSite.Com immediately of any unauthorized access or security breach
• Accept responsibility for all activities occurring under your account
• Use the Service only for lawful purposes

You may terminate your account at any time. Upon termination, you will lose access to your websites and content.

3. Use of the Service

MiKiSite.Com grants you a non-exclusive, non-transferable, revocable license to access and use the Service for building and publishing websites.

You agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Create or publish content that is defamatory, obscene, hateful, or illegal
• Upload malware, viruses, or any harmful code
• Engage in hacking, unauthorized access, or security breach attempts
• Scrape, crawl, or automate access without written permission
• Reverse engineer or decompile the Service
• Impersonate another person or entity
• Overload or disrupt the Service's infrastructure
• Resell or redistribute the Service without authorization

Image uploads are limited to 10MB per file. Images are automatically converted to WebP format for optimization.

4. User Content & Intellectual Property

You retain ownership of all original content you create and publish through the Service. MiKiSite.Com does not claim ownership of your content.

By uploading content, you grant MiKiSite.Com a non-exclusive, worldwide, royalty-free license to store, display, and distribute your content as necessary to operate the Service.

You are responsible for:

• Ensuring your content does not violate any laws or third-party rights
• Confirming you have the right to use all content including text, images, and media
• Obtaining necessary permissions for any third-party content

The Service, including its design, templates, code, and documentation, is owned by MiKiSite.Com and protected by copyright and intellectual property laws.

5. Service Availability & Modifications

MiKiSite.Com makes no warranty that the Service will be uninterrupted, error-free, or available at all times. The Service is provided "as-is" without guarantees of uptime or continuous operation.

MiKiSite.Com reserves the right to:

• Modify, enhance, or discontinue any feature of the Service
• Change pricing or introduce paid tiers
• Perform scheduled or emergency maintenance without prior notice
• Discontinue the Service entirely with 30 days' notice

6. Data & Backups

MiKiSite.Com implements multi-tenant architecture with data isolation between users. However, we do not guarantee the security of your data — no system is completely secure.

You are responsible for creating and maintaining your own backups. While we maintain operational backups, we do not guarantee data recovery in the event of loss.

Upon account deletion, your data will be retained according to applicable law and our Privacy Policy. After retention periods expire, data will be permanently deleted.

7. Limitation of Liability

MiKiSite.Com's total liability shall not exceed the amount you have paid in the twelve (12) months preceding the claim. If you have paid nothing, liability is limited to 100,000 VND.

MiKiSite.Com shall not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or business opportunity, or issues arising from your violation of these Terms.

8. Disclaimer of Warranties

The Service is provided "as-is" and "as available" without warranties of any kind, express or implied. MiKiSite.Com disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

You use the Service at your own risk and assume all responsibility for any damage or loss resulting from your use.

9. Indemnification

You agree to indemnify and hold harmless MiKiSite.Com, its founders, officers, employees, and agents from any claims, damages, losses, and expenses arising from your use of the Service, violation of these Terms, or violation of third-party rights.

10. Termination

You may terminate your account at any time by contacting [email protected] or using account settings.

MiKiSite.Com may suspend or terminate your account immediately without notice if you violate these Terms, engage in fraudulent or illegal activities, or pose a risk to the Service or other users.

Upon termination, your access is revoked, your websites may be taken offline, and surviving provisions continue to apply.

11. Privacy & Data Protection

Your use of the Service is subject to our separate Privacy Policy. Please review the Privacy Policy to understand our data handling practices and your rights regarding your personal data.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Socialist Republic of Vietnam. You agree to the exclusive jurisdiction of the courts located in Hanoi, Vietnam for any disputes arising from these Terms.

13. Dispute Resolution

Before pursuing legal action, you agree to attempt to resolve disputes through informal negotiation. Send a written description of the dispute to [email protected]. If the dispute cannot be resolved within 30 days, either party may pursue legal remedies.

14. General Provisions

If any provision of these Terms is found invalid, the remaining provisions continue in full effect. These Terms constitute the entire agreement between you and MiKiSite.Com. No waiver of any provision is effective unless in writing. MiKiSite.Com may assign its rights under these Terms; you may not assign without written consent.
